Since then he has worked tirelessly to gather evidence to prove Tina's innocence at her parole hearing ~ which was scheduled for April 2007. The hearing was rescheduled by Mr. Allen, in order that he would have enough time to gather &lt;em&gt;every shred of evidence in Tina's&lt;/em&gt; &lt;em&gt;defense.&lt;/em&gt; That evidence was turned in to the Georgia Board of Pardons &amp;amp; Paroles in October of 2007. As of the time of this posting, the Board has yet to reach a decision...&lt;/span&gt; &lt;/strong&gt;&lt;/span&gt;&lt;/div&gt;&lt;p align="center"&gt;&lt;br /&gt;&lt;/p&gt;&lt;div align="center"&gt;&lt;span style="font-family:trebuchet ms;color:#ff99ff;"&gt;&lt;strong&gt;Tina awaits word. She is anxious. The article brings to attention the questions involving the case, such as the death of Amber and the treatment of Tina's case by her then appointed GA defense attorney, Jimmy D. Berry. &lt;/strong&gt;&lt;/span&gt;&lt;/div&gt;&lt;p align="center"&gt;&lt;br /&gt;&lt;/p&gt;&lt;div align="center"&gt;&lt;span style="font-family:trebuchet ms;color:#cc33cc;"&gt;&lt;strong&gt;Please keep Tina in your prayers! These are Tina's words, as quoted in a phone interview conducted by one of Tina's friends and supporters Thomas Cooney.&lt;br /&gt;The entire interview can be seen at the following link &lt;/strong&gt;&lt;a href="http://fspp.net/christina_boyer.htm"&gt;&lt;strong&gt;&lt;span style="font-size:130%;color:#ffff00;"&gt;http://fspp.net/christina_boyer.htm&lt;/span&gt;&lt;/strong&gt;&lt;/a&gt;&lt;strong&gt;&lt;span style="font-size:130%;color:#ffff00;"&gt;&lt;br /&gt;&lt;/span&gt;&lt;/strong&gt;&lt;br /&gt;&lt;strong&gt;Tina is presently serving her sentence at Pulaski State Prison in Georgia.&lt;br /&gt;&lt;em&gt;&lt;span style="color:#3333ff;"&gt;We, her supporters and friends, feel that Tina is innocent of the crimes she has remained imprisoned for, for 15 and 1/2 years.&lt;br /&gt;&lt;/span&gt;&lt;/em&gt;&lt;span style="color:#6633ff;"&gt;Tina was at work when her little girl died.&lt;br /&gt;&lt;/span&gt;&lt;span style="color:#cc33cc;"&gt;Tina told the &lt;em&gt;truth &lt;/em&gt;and she continues to do so, whenever asked what happened on that fateful day.&lt;br /&gt;&lt;/span&gt;&lt;span style="color:#3333ff;"&gt;Her story has never changed a bit. &lt;/span&gt;&lt;/strong&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#3333ff;"&gt;&lt;br /&gt;&lt;/span&gt;&lt;/strong&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="color:#cc33cc;"&gt;Tina even passed a polygraph test indicating her innocence less than 24 hours before her sentencing.&lt;br /&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#3333ff;"&gt;The man whom Tina left Amber with the day she died, is serving a 20 year sentence in Wilcox State Prison in Georgia for cruelty to children. &lt;/span&gt;&lt;/strong&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#3333ff;"&gt;His name is &lt;/span&gt;&lt;span style="color:#cc33cc;"&gt;&lt;em&gt;David Herrin. &lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;br /&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="color:#3333ff;"&gt;His scheduled release date is 4/14/2012. &lt;/span&gt;&lt;/strong&gt;&lt;br /&gt;&lt;/em&gt;&lt;span style="color:#ff0000;"&gt;&lt;strong&gt;&lt;em&gt;David was found not guilty of murder on any of the three counts he was up&lt;/em&gt;&lt;/strong&gt; &lt;strong&gt;&lt;em&gt;against.&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;br /&gt;&lt;strong&gt;His trial was 2 months &lt;em&gt;after&lt;/em&gt; Tina signed the plea.&lt;br /&gt;&lt;/strong&gt;&lt;span style="color:#3333ff;"&gt;&lt;strong&gt;We guess that the jury figured if Tina admitted to wrong doing&lt;/strong&gt; &lt;strong&gt;&lt;em&gt;(by accepting the plea),&lt;/em&gt;&lt;/strong&gt; &lt;em&gt;&lt;strong&gt;then David was innocent&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt; &lt;span style="color:#ff0000;"&gt;&lt;strong&gt;&lt;em&gt;EVEN THOUGH HE HIMSELF STATED THAT TINA WASN'T HOME, SHE WAS AT WORK THAT DAY! &lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="color:#cc33cc;"&gt;&lt;strong&gt;&lt;span style="font-size:130%;"&gt;David has never admitted what &lt;em&gt;really&lt;/em&gt; happened to Amber the day he was left in charge of her little life...&lt;br /&gt;&lt;/span&gt;&lt;/strong&gt;&lt;br /&gt;&lt;/span&gt;&lt;em&gt;&lt;span style="color:#ff0000;"&gt;&lt;strong&gt;Portions of David's trial transcripts can be seen at the following link &lt;/strong&gt;&lt;/span&gt;&lt;/em&gt;&lt;a href="http://jamesaconrad.com/Tina/Tina-case-Page2.html"&gt;&lt;strong&gt;&lt;span style="font-size:130%;color:#ffff00;"&gt;http://jamesaconrad.com/Tina/Tina-case-Page2.html&lt;/span&gt;&lt;/strong&gt;&lt;/a&gt; &lt;/div&gt;&lt;div align="center"&gt;&lt;br /&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="font-size:130%;color:#cc33cc;"&gt;It is well worth taking the time to read these transcripts.&lt;br /&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;br /&gt;&lt;span style="font-size:130%;"&gt;&lt;span style="color:#ff0000;"&gt;&lt;strong&gt;&lt;em&gt;The medical examiner at David's trial said that Amber died from a blunt force blow to her head which had occurred within 30 minutes of her becoming unconscious. Why does she look like that? Oh, Jesus, I can’t get her to breathe.”&lt;br /&gt;Your man isn’t driving fast enough.&lt;br /&gt;You keep telling him to &lt;em&gt;&lt;span style="color:#ff0000;"&gt;drive faster, go around cars, go faster....&lt;/span&gt;&lt;/em&gt;&lt;br /&gt;You get to the hospital and &lt;span style="color:#ff0000;"&gt;you jump out of the car as it is stopping.&lt;/span&gt;&lt;br /&gt;&lt;span style="color:#ff0000;"&gt;You run into the E.R. screaming:&lt;/span&gt; “I have a baby, she’s not breathing. She has no pulse. Someone help me!”&lt;br /&gt;Someone takes your child and puts you in a room.&lt;br /&gt;Your man comes in.&lt;br /&gt;You keep asking him what happened.&lt;br /&gt;No answer.&lt;br /&gt;He has his hands covering his face.&lt;br /&gt;He mumbles over and over: &lt;em&gt;“I’m sorry!”&lt;/em&gt; but doesn’t answer your question- &lt;em&gt;for what&lt;/em&gt;?&lt;br /&gt;&lt;span style="color:#ff99ff;"&gt;&lt;em&gt;They call you in and the doctor comes in and says her heart stopped beating....&lt;br /&gt;&lt;/em&gt;He says they really did all they could, but she’s dead.&lt;br /&gt;You go to see her.&lt;br /&gt;She’s got tubes and stuff coming from everywhere it seems like.&lt;br /&gt;&lt;em&gt;You want to hold her but they will not let you touch her or go near her.&lt;br /&gt;&lt;/em&gt;&lt;/span&gt;Then your man gets slammed into the wall and handcuffed.&lt;br /&gt;&lt;/span&gt;&lt;/strong&gt;&lt;strong&gt;&lt;span style="color:#33ffff;"&gt;&lt;span style="color:#3366ff;"&gt;The police ask if you will come and give a witness statement.&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;/span&gt;&lt;/strong&gt;&lt;span style="color:#ff99ff;"&gt;&lt;em&gt;&lt;span style="font-family:trebuchet ms;"&gt;&lt;strong&gt;"In the space of a few hours, my world fell apart and my life was over. Amber is dead and I think if they just let me back there I can help her. I asked God to please take my life and not hers. She can’t really be dead. I can’t leave her here. What if she wakes up? She’ll be scared. She doesn’t know any of these people. But they kept asking me to come and talk."&lt;/strong&gt; ~ &lt;span style="font-size:78%;"&gt;TINA BOYER&lt;/span&gt;&lt;/span&gt;&lt;br /&gt;&lt;/em&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="color:#3333ff;"&gt;You are now at the police station in an office. &lt;/span&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#cc33cc;"&gt;They say you are NOT under arrest. &lt;/span&gt;&lt;br /&gt;&lt;span style="color:#cc33cc;"&gt;They do NOT read you your rights.&lt;/span&gt;&lt;br /&gt;&lt;span style="color:#ff99ff;"&gt;&lt;span style="color:#3333ff;"&gt;They begin to ask questions.&lt;/span&gt; &lt;/span&gt;&lt;br /&gt;&lt;span style="color:#ffff00;"&gt;Is your man abusive? &lt;/span&gt;&lt;br /&gt;&lt;span style="color:#ffff00;"&gt;You tell them no. &lt;/span&gt;&lt;br /&gt;&lt;span style="color:#ffff00;"&gt;You are not lying. &lt;/span&gt;&lt;br /&gt;&lt;span style="color:#ffff00;"&gt;The police begin to get mean when you tell them you don't know what happened to Amber. &lt;/span&gt;&lt;br /&gt;&lt;span style="color:#ffff00;"&gt;You tell them you were not there, you were at work. &lt;/span&gt;&lt;br /&gt;&lt;/strong&gt;&lt;strong&gt;&lt;span style="color:#3333ff;"&gt;They ask strange questions about you and your man's sex life.&lt;br /&gt;&lt;/span&gt;&lt;span style="color:#ff6666;"&gt;You go to stand up, say you want to leave. &lt;/span&gt;&lt;br /&gt;&lt;span style="color:#ff6666;"&gt;They put their hands on your shoulders and tell you to sit down, just a few more questions. &lt;/span&gt;&lt;br /&gt;&lt;span style="color:#ff0000;"&gt;You ask if you need a lawyer. &lt;/span&gt;&lt;br /&gt;&lt;span style="color:#3366ff;"&gt;They say no,&lt;/span&gt; &lt;span style="color:#ff0000;"&gt;you are not in trouble,&lt;/span&gt; &lt;/strong&gt;&lt;strong&gt;&lt;span style="color:#cc33cc;"&gt;you are not under arrest.&lt;br /&gt;&lt;/span&gt;&lt;span style="color:#3333ff;"&gt;For almost 12 hours you are questioned. &lt;/span&gt;&lt;br /&gt;&lt;span style="color:#3333ff;"&gt;You are so tired.&lt;/span&gt;&lt;br /&gt;&lt;span style="color:#3333ff;"&gt;You are so numb.&lt;/span&gt;&lt;br /&gt;&lt;span style="color:#ff0000;"&gt;Then they tell you that you are under arrest. &lt;/span&gt;&lt;br /&gt;&lt;/strong&gt;&lt;span style="color:#3333ff;"&gt;&lt;strong&gt;You have no money, no savings, no attorney.&lt;br /&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#ff99ff;"&gt;&lt;span style="font-size:130%;"&gt;&lt;em&gt;&lt;strong&gt;For 18 MONTHS you sit in jail&lt;/strong&gt;&lt;/em&gt;...&lt;br /&gt;&lt;/span&gt;&lt;/span&gt;&lt;strong&gt;&lt;span style="color:#cc33cc;"&gt;You are depressed, heavily medicated on pills they give to you to help you cope. You don't know if you'll ever get out of there. &lt;/span&gt;&lt;br /&gt;&lt;span style="color:#cc33cc;"&gt;You don't even really know what's going on. &lt;/span&gt;&lt;br /&gt;Finally &lt;em&gt;you are assigned a &lt;span style="color:#cc33cc;"&gt;public defender.&lt;/span&gt;&lt;/em&gt;&lt;br /&gt;&lt;span style="color:#3333ff;"&gt;He only visits you twice. &lt;/span&gt;&lt;br /&gt;&lt;/strong&gt;&lt;span style="color:#3333ff;"&gt;&lt;strong&gt;He will not write back to you or anyone else who sends him letters asking about your case.... &lt;/strong&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="color:#3333ff;"&gt;&lt;strong&gt;&lt;br /&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#ff0000;"&gt;Very soon before your trial your public defender comes to see you in jail. &lt;/span&gt;&lt;br /&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="color:#ff0000;"&gt;He tells you that he does not feel that he can defend you. &lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;br /&gt;&lt;span style="color:#ff0000;"&gt;&lt;em&gt;&lt;strong&gt;He tells you he thinks it is best if you DO NOT go to trial.&lt;/strong&gt;&lt;/em&gt; &lt;/span&gt;&lt;br /&gt;&lt;span style="color:#ff0000;"&gt;You are offered a plea bargain... &lt;/span&gt;&lt;br /&gt;&lt;span style="font-size:130%;color:#ff99ff;"&gt;&lt;strong&gt;&lt;em&gt;Life in prison&lt;br /&gt;plus 20 years...&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;br /&gt;&lt;em&gt;panic dulled by anti- everything pills... &lt;/em&gt;&lt;br /&gt;&lt;span style="font-size:130%;"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="color:#6600cc;"&gt;what do you do???&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt; &lt;/span&gt;&lt;br /&gt;&lt;span style="color:#6600cc;"&gt;&lt;strong&gt;This is the person who is supposed to defend you. &lt;/strong&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="color:#3333ff;"&gt;&lt;em&gt;&lt;strong&gt;You wonder why God has left you alive...&lt;br /&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="color:#ff99ff;"&gt;&lt;em&gt;&lt;span style="font-family:trebuchet ms;"&gt;&lt;strong&gt;&lt;span style="font-family:trebuchet ms;"&gt;"Why did I take a plea? Oh, how I have asked myself that so many times throughout the years, and I don’t really have a straight answer for that. I know how I felt; I know what I believed, which turned out to be not true. So much went on in that short span. One minute, I thought I had a lawyer and the next, I find out I’m not getting a trial because my lawyer says I’m going to die, he can’t help me. My impression was this: (My defender) was basically telling me if I went to court, I’ll die. He led me to believe I’d go home soon. He put the pressure on and didn’t want me to talk to anyone. Nothing he said made sense to me. All I really understood was if I went to trial, my lawyer wouldn’t help me.
