In the fall of 2006 an attorney in Georgia, Richard Allen, took an interest in Tina's case. Since then he has worked tirelessly to gather evidence to prove Tina's innocence at her parole hearing ~ which was scheduled for April 2007. The hearing was rescheduled by Mr. Allen, in order that he would have enough time to gather every shred of evidence in Tina's defense. That evidence was turned in to the Georgia Board of Pardons & Paroles in October of 2007. As of the time of this posting, the Board has yet to reach a decision...

Tina awaits word. She is anxious. She is tired.

An article was published by Sue Horn in the Carroll Star News last month about Tina's case. The article brings to attention the questions involving the case, such as the death of Amber and the treatment of Tina's case by her then appointed GA defense attorney, Jimmy D. Berry.

Please keep Tina in your prayers!

We still wait to see justice served here, if that is possible at this point. Tina has lost Amber and she has lost nearly 16 years of her life in prison for a crime she did not commit...

She deserves justice.

The murderer of Amber deserves justice.....

Amber deserves justice.

So those who love Tina wait with her for a reply.

Tina was facing death by electrocution on three different charges of murder, each carrying the death penalty.
She knew she had no help from her public defender.

Scared and with nowhere to turn, after having been in jail for over 2 and 1/2 years, Tina signed the plea just seven days before her trial was to begin.

All of this is what truly happened on April 14, 1992, the day that Amber died. These are Tina's words, as quoted in a phone interview conducted by one of Tina's friends and supporters Thomas Cooney.

Tina is presently serving her sentence at Pulaski State Prison in Georgia.
We, her supporters and friends, feel that Tina is innocent of the crimes she has remained imprisoned for, for 15 and 1/2 years.
Tina was at work when her little girl died.
Tina told the truth and she continues to do so, whenever asked what happened on that fateful day.
Her story has never changed a bit.

Tina even passed a polygraph test indicating her innocence less than 24 hours before her sentencing.

The man whom Tina left Amber with the day she died, is serving a 20 year sentence in Wilcox State Prison in Georgia for cruelty to children.
His name is David Herrin.
His scheduled release date is 4/14/2012.
David was found not guilty of murder on any of the three counts he was up against.
His trial was 2 months after Tina signed the plea.
We guess that the jury figured if Tina admitted to wrong doing (by accepting the plea), then David was innocent EVEN THOUGH HE HIMSELF STATED THAT TINA WASN'T HOME, SHE WAS AT WORK THAT DAY!
David has never admitted what really happened to Amber the day he was left in charge of her little life...

The medical examiner at David's trial said that Amber died from a blunt force blow to her head which had occurred within 30 minutes of her becoming unconscious. Therefor, obviously, Tina is not at fault for the death of her daughter...

... you scoop her up and run for the car screaming, “She’s not breathing, drive!” You begin C.P.R. on your child while she lies in your lap.
You are breathing in her mouth and there is this horrible smell that keeps making you gag.
You are screaming. “What happened to her? Why does she look like that? Oh, Jesus, I can’t get her to breathe.”
Your man isn’t driving fast enough.
You keep telling him to drive faster, go around cars, go faster....
You get to the hospital and you jump out of the car as it is stopping.
You run into the E.R. screaming: “I have a baby, she’s not breathing. She has no pulse. Someone help me!”
Someone takes your child and puts you in a room.
Your man comes in.
You keep asking him what happened.
No answer.
He has his hands covering his face.
He mumbles over and over: “I’m sorry!” but doesn’t answer your question- for what?
They call you in and the doctor comes in and says her heart stopped beating....
He says they really did all they could, but she’s dead.
You go to see her.
She’s got tubes and stuff coming from everywhere it seems like.
You want to hold her but they will not let you touch her or go near her.
Then your man gets slammed into the wall and handcuffed.
The police ask if you will come and give a witness statement.

"In the space of a few hours, my world fell apart and my life was over. Amber is dead and I think if they just let me back there I can help her. I asked God to please take my life and not hers. She can’t really be dead. I can’t leave her here. What if she wakes up? She’ll be scared. She doesn’t know any of these people. But they kept asking me to come and talk." ~ TINA BOYER

You are now at the police station in an office.
They say you are NOT under arrest.
They do NOT read you your rights.
They begin to ask questions.
Is your man abusive?
You tell them no.
You are not lying.
The police begin to get mean when you tell them you don't know what happened to Amber.
You tell them you were not there, you were at work.
They ask strange questions about you and your man's sex life.
You go to stand up, say you want to leave.
They put their hands on your shoulders and tell you to sit down, just a few more questions.
You ask if you need a lawyer.
They say no, you are not in trouble, you are not under arrest.
For almost 12 hours you are questioned.
You are so tired.
You are so numb.
Then they tell you that you are under arrest.
You have no money, no savings, no attorney.
For 18 MONTHS you sit in jail...
You are depressed, heavily medicated on pills they give to you to help you cope. You don't know if you'll ever get out of there.
You don't even really know what's going on.
Finally you are assigned a public defender.
He only visits you twice.
He will not write back to you or anyone else who sends him letters asking about your case....

Very soon before your trial your public defender comes to see you in jail.
He tells you that he does not feel that he can defend you.
He tells you he thinks it is best if you DO NOT go to trial.
You are offered a plea bargain...
Life in prison
plus 20 years...
panic dulled by anti- everything pills...
what do you do???
This is the person who is supposed to defend you.
You wonder why God has left you alive...

"Why did I take a plea? Oh, how I have asked myself that so many times throughout the years, and I don’t really have a straight answer for that. I know how I felt; I know what I believed, which turned out to be not true. So much went on in that short span. One minute, I thought I had a lawyer and the next, I find out I’m not getting a trial because my lawyer says I’m going to die, he can’t help me. My impression was this: (My defender) was basically telling me if I went to court, I’ll die. He led me to believe I’d go home soon. He put the pressure on and didn’t want me to talk to anyone. Nothing he said made sense to me. All I really understood was if I went to trial, my lawyer wouldn’t help me. I couldn’t defend myself so I’ll die." ~ TINA BOYER

Meet Tina....

For a moment pretend....

Your three year old is sitting cozy in the lap of the man you will soon marry, waiting to be read her favorite book as you leave out the door to work.

It is a normal day at work, and at it's end you get in the car to drive home, thinking of what to fix for dinner, looking forward to seeing your kid and your man...

You pull up to home, put the car in park, turn the key, begin to gather your purse and work papers...
then you see your man on the porch.
You holler out cheerfully, "Hey! Whatcha doin'?"
He hollers back, "I can't wake Amber."
"What do you mean?" ... you ask, as you walk up to the house, thinking Amber has overslept her nap...

"I can't wake Amber," says your man.

Your heart begins to beat heavier...
and faster...
as you rush to the bedroom
where you find your three year old daughter in bed.
You
call
her
name
as you pull the covers down and put your head to her chest....

You hear no heartbeat, only the echo of your own as it pounds furiously in a body you no longer feel a part of....

A thrush of panic....
You swoop up your child...

Sound like a movie?... A bad dream?
